These general terms and conditions and Anassa Travel & Tourism KB's through its website www.corfuholidayservices.com (hereinafter referred to as the "tour operator") in individual cases special travel terms are part of the agreement when you (hereinafter referred to as the "traveller") book with us. The general travel conditions are agreed between the Travel Agency Association in Sweden and the Swedish Consumer Agency on September 1, 2014. Special travel conditions are stated in italics. If the travel conditions are contradictory, the general terms of travel apply unless the special travel conditions are more favorable to the traveller.

  1. THE AGREEMENT
    1. The tour operator is liable to the traveller for what he or she is entitled to claim as a result of the agreement. The responsibility also applies to such performances whcish are to be accomplished by someone other than the tour operator. If the reseller is a party to the agreement, he is responsible to the traveller in the same way as the tour operator.
      1. The main traveller is the person in whose name the agreement has been reached. The main traveller is first mentioned in the travel documents or in another clear way. The main traveller is responsible for payment under the agreement. All changes and cancellations must be made by the main traveller. Exceptions can be made if the main traveller becomes seriously ill and can not make the change or cancellation. The main traveller is responsible for providing the tour operator with correct booking information for other travellers covered by the agreement.
      2. If the traveller is under 18 years of age and travels without a guardian, this must be stated at the time of booking. Certificates showing approval from all guardians must be submitted to the tour operator before payment of the trip is made.
    2. The tour operator shall keep the traveller informed on matters of relevance to the traveller associated with the agreement.
    3. Connection or special arrangement are included in the agreement only if it is sold or marketed together with the main arrangement for a common price or for separate prices linked to each other.
    4. The agreement is binding on the parties when the tour operator has confirmed the traveller's order in writing and the traveller has paid agreed registration fee in accordance with the tour operator's instructions.
    5. The tour operator must confirm the traveller's order without delay.
    6. Wishes are not guaranteed.
    7. The traveller is required to check the travel documents as soon as they are received. Any errors must be addressed as soon as possible. A fee may be charged for the correction of information.
  2. PAYMENT OF THE PRICE FOR THE TRIP
    1. The traveller must pay the travel price at the latest time as stated in the agreement.
    2. The tour operator may not require final payment of the travel price earlier than 40 days prior to departure, unless otherwise agreed.
    3. In connection with the booking confirmation, the tour operator may issue a first installment fee (registration fee). The registration fee should be reasonable in relation to the price of the trip and the circumstances in general.
    4. If the traveller does not pay the travel price in accordance with the agreement, the tour operator has the right to cancel the agreement and retain the registration fee as compensation unless this is unreasonable.
  3. TRAVELLER'S RIGHT TO CANCELLATION
    1. The traveller is entitled to cancel the trip as follows:
      1. If canceled earlier than 30 days before departure, the traveller shall pay the registration fee as a cancellation fee.
      2. If canceled thereafter, but earlier than 14 days before departure, the traveller shall pay 25% of the travel price, but not lower than the registration fee.
      3. If canceled thereafter, but earlier than 8 days before departure, the traveller shall pay 50% of the travel price, but not lower than the registration fee.
      4. If canceled within 8 days before departure, the traveller shall pay the full fare.
  4. TRAVELLER'S CHANGES OF THE TRIP
    1. The traveller is entitled to change the agreement if the tour operator agrees to this. Changes to the agreement may incur additional costs for the traveller by the tour operator or other.
  5. TRAVELLER'S RIGHT TO TRANSFER THE AGREEMENT
    1. The traveller may transfer the agreement to anyone who meets all the requirements for taking part in the trip. The traveller must inform the tour operator or reseller about the transfer in due time before departure.
    2. The transferee and the acquirer are jointly and severally liable to the tour operator or reseller for all remaining outstanding for the trip and for extra costs, no more than SEK 500. The amount limit does not apply if the tour operator can show that the actual cost of the transfer amounts to a higher amount which may in this case be charged.
  6. TOUR OPERATOR'S CHANGES BEFORE DEPARTURE
    1. The tour operator's right to change the terms of the agreement
      1. The tour operator may change the terms of the agreement to the traveller's disadvantage only if it is clear by the agreement that it may occure.
      2. If the tour operator intends to terminate the agreement or change the terms of the agreement, the tour operator shall notify the traveller as soon as possible and, in so doing, disclose his right to withdraw from the agreement in accordance with section 6.4.
    2. Change of price
      1. If the tour operator's cost increases after the agreement has become binding on the parties, the tour operator may increase the price for the trip by an amount corresponding to the cost increases if these are due to:
        • changes in transportation costs
        • changes in taxes, duties or fees relating to services included in the trip; or
        • changes in exchange rates that affect the tour operator's travel costs.
      2. The price may be increased by an amount corresponding to the traveller's share of the cost increase suffered by the tour operator for the performance of the contract, provided that this cost increase is of the kind specified in (a) - (c) above in this paragraph. For example, if a fee according to item (a) above increases by SEK 100 for each traveller, the price of the trip may be increased by the same amount. The tour operator is required to report on the traveller's request how the price increase has been calculated. The right to price increase according to (a) - (c) of this paragraph is only if the cost increase in total exceeds SEK 100.
      3. Travel price shall be reduced if the tour operator's costs, for reasons stated above, decrease by a total of at least 100 SEK.
      4. The tour operator shall notify the traveller as soon as possible of the price changes. The price may not be increased and also need not be reduced during the last 20 days prior to the agreed departure date.
    3. Schedule changes
      1. The times of departure and return journey in the booking confirmation are provisional. The tour operator shall specify the departure times that will apply for the trip as soon as possible and no later than 20 days before departure.
    4. The right of the traveller to withdraw from the agreement
      1. The traveller may withdraw from the agreement if the tour operator will not fulfill his obligations and the breach of contract is of vital importance to the traveller.
      2. The traveller shall inform the tour operator or reseller within a reasonable time if he wishes to withdraw from the agreement as described above. If the traveller does not, he will lose his right to withdraw from the agreement.
    5. The traveller's right to compensation
      1. If the traveller disregards the agreement pursuant to paragraph 6.4, he is entitled to another package trip of the same or higher quality, if the tour operator can offer this. If the traveller accepts a poorer replacement trip, he is entitled to compensation for the price difference.
      2. If the traveller waives his or her right to a return trip, or if such a trip is not offered, the traveller shall get back what he has paid under the agreement as soon as possible but no later than 14 days after the waiver.
      3. The provisions of paragraphs 6.5.1 and 6.5.2 also apply if the tour operator cancels the trip without the traveller liability.
    6. The traveller's right to compensation, the tour operator's cancellation of the trip
      1. In cases referred to in section 6.5, the traveller is entitled to compensation from the tour operator, if it is reasonable.
      2. The right to compensation due to the cancellation of the trip does not exist if the tour operator shows:
        • that fewer persons than a minimum number specified in the contract have signed up for the trip and the traveller is notified in writing of the cancellation of the journey within in the agreement specified time limit ; or
        • the trip could not be carried out due to obstacles outside the tour operator's control that he or she could not reasonably be expected to have taken into account when the contract was concluded and whose consequences the tour operator could not reasonably have avoided or overcome.
        The right of the tour operator and traveller to withdraw from the agreement in case of intervention events etc.
      3. If it is depending on someone hired by the tour operator that the trip has been canceled, the tour operator is free from liability under paragraphs 6.6.1 and 6.6.2 only if the person whom he has hired will also be free according to that provision. The same applies if the cause is attributable to someone else in a previous link.
    7. The right of the tour operator and traveller to withdraw from the agreement in case of intervention events etc.
      1. Both the organizer and the traveller have the right to withdraw from the agreement, if after the agreement has become binding to the parties at or near the destination or along the planned route, disaster, war action, general strike or other intervention event that significantly affects the travel's performance or the conditions of the destination at the time of the trip.
      2. In order to investigate whether the event is of such serious nature as stated above, expert Swedish or international authorities should be consulted.
  7. THE TOUR OPERATOR'S CHANGES AFTER DEPARTURE
    1. Non-fulfilled agreements
      1. If after departure a substantial part of the contracted services can not be provided, the tour operator shall arrange for appropriate compensation arrangements at no extra cost to the traveller.
      2. If compensation arrangements are not arranged or such arrangements are refused by the traveller on acceptable grounds, the tour operator shall, if reasonable and at no extra cost to the traveller, provide equivalent transportation back to the place of departure or to another place that the traveller approves.
      3. If a change in the agreement according to the first or second paragraph implies a impairment for the traveller, he is, if it is reasonable, entitled to deductions and damages.
    2. Other errors and shortcomings
      1. In the event of other errors in the services contracted than those mentioned in section 7.1, the traveller is entitled to deductions and damages, unless the fault is due to him.
      2. The traveller is not entitled to compensation if the tour operator shows that the error is due to an obstacle beyond the tour operator's control, which it could not reasonably be expected to have taken into account when the contract was concluded and the consequences of which it could not reasonably have avoided or overcome.
      3. If the fault is due to someone hired by the tour operator, the tour operator is free from liability for damages under these terms and conditions only if the person whom he has hired will also be free according to that provision. The same applies if the error is due to someone else in a previous link.
      4. In the case of faults which are due to circumstances described in 7.2.2 and 7.2.3, the tour operator shall immediately provide the traveller with the necessary assistance.
    3. The extent of the damage / compensation
      1. Damages under these conditions include compensation for pure financial loss, compensation for personal injury and property damage. It is the duty of the traveller to limit the damage as far as possible.
  8. RECLAMATION AND ASSISTANCE
    1. The traveller may not invoke any errors in the agreed services if he does not inform the tour operator or reseller about the error within a reasonable time after he or she noticed or should have noticed the error. This should happen if possible on the travel destination.
    2. By way of derogation from section 8.1, the traveller may invoke errors if the tour operator or reseller has acted grossly negligently or contrary to faith and honor.
    3. If the traveller during the trip is making a complaint, the tour operator or his local representative shall immediately take steps to find a suitable solution.
  9. RESPONSIBILITY OF THE TRAVELLER DURING THE TRIP
    1. The tour operator's instructions
      1. The traveller is required to comply with the instructions for the trip's implementation provided by the tour leader or by another person whom the tour operator hires. The traveller is obliged to comply with the rules for the trip and at the travel destination and behave so that fellow travellers or others are not disturbed . If the traveller in a significant way violates this, the tour operator may cancel the agreement.
    2. The traveller's liability for damage
      1. The traveller is liable for any damages to the tour operator caused by the traveller through negligence.
    3. The traveller is responsible for formalities
      1. The traveller is responsible for complying with the necessary formalities for the trip's implementation, such as possession of valid passports, visas, vaccinations, insurance.
      2. The traveller is responsible for all costs incurred due to shortcomings in such formalities, such as home transport due to a lack of passport, unless the defects are caused by incorrect information from the tour operator or reseller.
      3. The traveller is responsible for receiving information provided by the tour operator.
    4. Deviation from the arrangement
      1. The traveller who, following the commencement of the trip, deviates from the event is required to inform the tour operator or his representative.
  10. DISPUTE RESOLUTION
    1. The parties should attempt to settle disputes concerning the interpretation or application of the agreement through negotiations. If the parties can not agree, the dispute can be tried by the Swedish General Complaints Board or by Swedish General Court.
    2. In case of any difference between the Swedish and English versions of this agreement, the Swedish version applies.
